The Weekly Standard: Obama-Appointed Judge Claims Obamacare Does Not Fund Abortions

A federal judge in Ohio named Timothy S. Black, who was appointed by President Obama in 2009, claims that Obamacare does not fund abortions. Black ruled today in favor of former Democratic congressman Steve Driehaus, who filed a defamation suit against the Susan B. Anthony List. The SBA List ran ads claiming Driehaus had voted for taxpayer-funding of abortion by voting for Obamacare. “The express language of the PPACA does not provide for tax-payer funding abortion. That is a fact, and it is clear on its face,” Judge Black ruled.

Obama-Appointed Judge Claims Obamacare Does Not Fund Abortions

A federal judge in Ohio named Timothy S. Black, who was appointed by President Obama in 2009, claims that Obamacare does not fund abortions. Black ruled today in favor of former Democratic congressman Steve Driehaus, who filed a defamation suit against the Susan B. Anthony List. The SBA List ran ads claiming Driehaus had voted for taxpayer-funding of abortion by voting for Obamacare. “The express language of the PPACA does not provide for tax-payer funding abortion.  That is a fact, and it is clear on its face,” Judge Black ruled.

But the SBA List’s claim is true. If Obamacare ever goes into full effect, every federally subsidized health insurance “exchange” must offer at least one policy that covers elective abortions. Despite Obamacare’s attempt to “segregate” federal dollars to keep them from paying for abortions, the fact is that individuals may use Obamacare’s federal subsidies to purchase insurance plans that cover elective abortions. That’s a huge change from current law, and it amounts to taxpayer-funding of abortion.
