SCOTUS: Idaho Can Protect Babies & Mothers While Fighting Biden Admin Lawsuit

Second Loss for Biden’s Extreme Pro-Abortion Agenda in One Week

Washington, D.C. – The U.S. Supreme Court today determined that Idaho’s law protecting babies broadly through pregnancy will stand while the state fights the Biden administration’s extreme efforts to force emergency room doctors to carry out abortions.

In a similar case, on Tuesday the 5th U.S. Circuit Court of Appeals blocked the Biden administration’s actions in State of Texas v. Becerra. The Court rebuked the administration’s distortion of federal law known as the Emergency Medical Treatment and Active Labor Act (EMTALA), which protects both women and babies in the womb.

Like every state with strong pro-life laws, Idaho and Texas allow timely and necessary care for pregnant women in an emergency; that has not changed.

Susan B. Anthony Pro-Life America President Marjorie Dannenfelser welcomed the Supreme Court’s move, saying:

“For the second time this week, federal courts have delivered a big win for babies, mothers and the doctors who care for them. In the case of pregnancy, the Emergency Medical Treatment and Active Labor Act specifically says that hospitals must consider two patients: the mother and her unborn child. There is no basis whatsoever in this law for forcing doctors to carry out abortions even against their better medical judgment. The 5th Circuit already made that crystal clear, rejecting the Biden administration’s false and radical interpretation that ignored the baby altogether. Now the Supreme Court has affirmed that Idaho’s protections for babies and women will remain fully in effect while the Court hears these cases.

“In the Dobbs era, 24 states have laws protecting babies in the womb from brutal abortions, and every one of them also ensures life-saving care for pregnant mothers during medical emergencies. This includes Idaho and Texas, the two states targeted by the Biden administration. We are encouraged by today’s decision and look forward to a thorough rebuke of the Democrat agenda of imposing no-limits abortion on demand, through all nine months, in all 50 states.”
