
Momentum is building in the states for action on abortion drugs. Empowered by a Biden Covid-era policy that ended in-person doctor visits, blue-state abortion businesses are undermining pro-life laws in 21 states. These abortion drug mills ship pills into red states –- killing unborn children, sending women and girls to the hospital, and allowing abusers to coerce and poison women with the drugs.
Here are six states suing to stop the flood of these dangerous, deregulated drugs.
Florida Attorney General James Uthmeier and Texas Attorney General Ken Paxton sued the FDA this month over its illegal actions in approving and progressively eliminating safety standards on abortion drugs. Florida and Texas note, “The FDA’s regulation of mifepristone was political from the start,” with the Clinton administration redefining pregnancy as an illness to push the drug approval through faster.
Democrat officials knew abortion drugs would be used to undermine pro-life state laws – especially if Roe v. Wade were reversed. Unwanted and coerced abortions reaching epidemic levels is just one part of the fallout, with cases of abortion drug poisoning in at least seven states. Attorney General Uthmeier notes these dangerous drugs are even getting into the hands of minors.
Texas Attorney General Ken Paxton has been taking action on multiple fronts against out-of-state abortion drug pushers breaking the law and putting Texans in danger. In August, he issued cease and desist letters to Plan C, Her Safe Harbor, and Coeytaux.

Led by Attorney General Liz Murrill, the State of Louisiana and abortion drug coercion survivor Rosalie Markezich are suing the FDA. Abortion drug poisoning is a crime in Louisiana. But out-of-state bad actors don’t care. To them, women who are poisoned are collateral damage.
Markezich’s boyfriend pushed her to abort her baby using abortion drugs he ordered online, using his own name.
“If the Biden FDA had not removed in-person dispensing, my then-boyfriend would not have been able to obtain abortion drugs and pressure me to take them against my will,” she says – and her baby would still be alive.
These states are challenging the FDA’s move to approve a new generic abortion drug “despite mounting evidence that the drug poses serious, even life-threating harm to pregnant women.”
Missouri Attorney General Catherine Hanaway wrote, “No caring physician would call mifepristone ‘as safe as Tylenol.’ That claim was always false. Women are ending up in emergency rooms, and manufacturers know it.”
Idaho Attorney General Labrador has consistently condemned the Biden mail-order abortion drug rule that remains inexplicably in force.

Kansas Attorney General Kobach has said, “The actions of the FDA are not only injurious to the unborn with dangerous consequences to the mothers, but also injurious to states’ rights with dangerous consequences to our Constitution.”
Attorneys General Uthmeier, Paxton, Murrill, Hanaway, Labrador and Kobach are standing for women, children, and the rule of law. Ultimately, as Attorney General Murrill points out, the states cannot do it alone – national leadership is needed: “New data show that the problem far outpaces individual enforcement efforts. Pro-abortion states have refused to enforce judgments or extradite mail-order abortion drug providers… A growing number of states have also started anonymizing abortion drug prescriptions ‒ making enforcement at this granular level all but impossible.”
Marjorie Dannenfelser, president of SBA Pro-Life America, is calling for immediate action:
“Right now, at minimum, they should heed the emerging science and the will of the people and immediately reinstate in-person doctor visits that existed before Biden’s harmful COVID policy. Twenty-one states whose laws are being undermined and their most vulnerable populations threatened by the flood of out-of-state drugs will thank them.”
