Federal Court Upholds WV’s Broad Protections for Unborn Children

Fight to Hold FDA Accountable for Dangerous Mail-Order Abortion Drugs Continues

HUNTINGTON, W.V. – On Thursday the U.S. District Court for the Southern District of West Virginia found the state’s Unborn Child Protection Act to be constitutional, dismissing nearly all claims brought by the abortion lobby. The law protects unborn babies broadly throughout pregnancy, with exceptions for rape, incest, fetal anomaly and to save the life of the mother.

However, the Court sided with the Biden administration which loosened safety standards on abortion pills – allowing them to be sent by mail. Earlier this month the 5th U.S. Circuit Court of Appeals found that the FDA likely broke the law; the case awaits Supreme Court review.

“West Virginia is a pro-life state and we are pleased the Court respected the will of the people to protect babies and support mothers. The Unborn Child Protection Act is estimated to save more than 1,300 lives in the Mountain State each year. A year after the Dobbs victory, 25 states – half the country – have strong protections for life in their laws.

“At the same time, this decision raises the stakes of the fight against dangerous mail-order abortion pills. One of the abortion lobby’s favorite talking points states abortion is ‘between a woman and her doctor.’ But it is the pro-abortion Biden administration that played politics and stripped away in-person medical supervision – pushing DIY at-home abortions that pose a 53% greater risk of an ER visit for complications, such as severe pain, heavy bleeding, the need for follow-up surgery and even death. This battle is not over. We stand with the brave doctors taking on the FDA, with Attorney General Morrisey, and with all our allies fighting to hold the abortion industry accountable for injuring countless women as well as taking the lives of children.”

In March, Governor Jim Justice signed a law establishing the West Virginia Mothers and Babies Pregnancy Support Program to support mothers by creating a funding mechanism for the state’s pregnancy help centers, with $1 million allocated by the state legislature for its first year.
