Careless Democrats Attack SCOTUS, Seek to Expand From 9 to 13 Seats

SBA List’s Dannenfelser: “Court-Packing is Court-Destroying”

Washington, D.C. In response to news that Democrats in the U.S. Senate and House of Representatives have introduced legislation to expand the Supreme Court, the national pro-life group Susan B. Anthony List (SBA List) issued the following statement:

“When pro-abortion Democrats experience losses, they dismantle sustaining American institutions rather than work within them, in the ingenious way the Founders provided. There is no rule they won’t violate or rewrite in their drive to impose their abortion agenda before the 2022 midterm elections, no matter the collateral damage to our nation,” said SBA List President Marjorie Dannenfelser. “Unanswerable to the electorate, the Supreme Court has already overstepped too often to legislate and impose policy on issues like abortion – not resolving debate but deepening it. The answer is not to further politicize the coequal judicial branch. After announcing a commission to ‘study’ the idea of altering the Court, President Biden’s allies in Congress have revealed their shared intention to impose a radical agenda on the American people regardless of consequences.

“Make no mistake: Court-packing is court-destroying. These assaults on innocent unborn children and the foundations of America are deeply unpopular and pro-abortion Democrats pursue them at their own political peril.”

Expanding the size of the Supreme Court was opposed by the late Justice Ruth Bader Ginsburg who said, “Nine seems to be a good number. It’s been that way for a long time. I think it was a bad idea when President Franklin Roosevelt tried to pack the court…If anything would make the court look partisan, it would be that — one side saying, ‘When we’re in power, we’re going to enlarge the number of judges, so we would have more people who would vote the way we want them to.’”

Further, current Supreme Court Justice Stephen Breyer gave recent remarks saying, “It is wrong to think of the Court as another political institution. And it is doubly wrong to think of its members as junior league politicians.” Breyer explained, “I hope and expect that the court will retain its authority. But that authority, like the rule of law, depends on trust, a trust that the court is guided by legal principle, not politics. Structural alteration motivated by the perception of political influence can only feed that perception, further eroding that trust.”
