80+ Pro-Life Groups, Leaders Sign Letter Urging Acting AG Blanche to Resolve Abortion Drug Lawsuit Immediately

Washington, D.C. – A coalition of 83 state and national pro-life groups, led by SBA Pro-life America, sent a letter to Acting U.S. Attorney General Todd Blanche urging the Department of Justice to resolve the Louisiana v. FDA lawsuit by agreeing to a court-ordered consent decree that would get abortion drugs out of the mail immediately while the FDA completes a prompt, rigorous safety review.

The DOJ now opposes Louisiana’s and abortion drug coercion survivor Rosalie Markezich’s request to expedite the case. The letter highlights Markezich’s testimony stating, “If mail-order abortion wasn’t a thing, I’m 100% sure I would have my child.”

The letter comes as Blanche is scheduled to appear for a confirmation hearing in the Senate Judiciary Committee on July 15 for consideration of his nomination by President Trump to serve as attorney general. U.S. Senator Josh Hawley (R-MO), a member of the committee, has also called on Blanche to settle the case.

It reads in part:

Pro-life states cannot enforce their laws while an FDA regulation gives cover to mail-order abortionists and DOJ defends the profits of abortion drug manufacturers. The current regime undermines state laws, including basic protections against practicing medicine without a license, while shield-law abortionists ship drugs across state lines with impunity.

Every month DOJ delays, abusers retain a dangerous tool for coercion, state laws are undermined, unborn children are killed, and women face preventable risks. We respectfully urge you to settle Louisiana v. FDA, end DOJ’s defense of the mail-order abortion drug regime, and stand with pro-life states and women like Rosalie.

“The FDA’s mail-order abortion drug regime is indefensible on science and the law, a textbook case of ‘arbitrary’ and ‘capricious’ government rulemaking according to federal law. We stand with our scores of national and state allies in urging Acting Attorney General Blanche to settle the case with Louisiana, so the FDA can restore in-person dispensing immediately while finishing its safety review. It’s time to stop warring with pro-life states, women and children, and the GOP’s pro-life base.

“Under the mail-order abortion drug regime, more abortions happen in America now than on the day the Dobbs victory came down four years ago—fueled by the abortion industry’s strategy of pushing unaccountable, dangerous drugs, just a click away, without ever seeing a doctor in person. New data suggest over 18,000 more unborn children lost their lives in 2025 compared to 2024, for a total of roughly 1.1 million annual deaths. Fifteen thousand babies die monthly just in states with pro-life laws. Meanwhile, yet another woman was rushed to the ER after a man forced abortion drugs on her against her will, and her baby is fighting for survival in the NICU. This is a national tragedy and we must treat it like the crisis it is.

The letter also notes the strong likelihood that the Biden’s abortion rule violates the Administrative Procedure Act. Louisiana argues Biden failed to consider adequate safety data and evaluate the harmful consequences of the policy and instead acted for political reasons after the Dobbs decision, according to HHS Secretary Kennedy’s own testimony to a Senate committee.

Previously the 5th Circuit Court of Appeals granted an immediate halt to the FDA’s policy allowing mail-order mifepristone. The Supreme Court then refused to stop the mail-order abortion drug regime during pending litigation.

The letter also cites polls finding 7 in 10 voters support in-person dispensing, with one third of GOP primary voters less enthusiastic to vote and volunteer if the party abandons pro-life policies.
