SBA to Blanche: Immediately End the Mail-Order Abortion Drug Regime Killing Babies, Harming Women & Nullifying State Laws

Washington, D.C. – The State of Louisiana and abortion drug coercion survivor Rosalie Markezich have filed their latest brief requesting expedited review from the 5th Circuit in their ongoing lawsuit against the U.S. Food and Drug Administration for removing in-person guardrails on dangerous abortion drugs.

SBA Pro-Life America called on the Department of Justice to bring a swift end to the lawsuit in a statement:

“We urge acting Attorney General Todd Blanche to settle this case by agreeing to a court-ordered consent decree that would end Biden’s unlawful mail-order abortion drug policy and restore in-person dispensing immediately while the FDA completes a prompt, rigorous safety review,” said SBA Pro-Life America President Marjorie Dannenfelser.

“The consequences of inaction are staggering. Pro-life laws enacted following the Dobbs victory are effectively nullified, 15,000 babies in states with pro-life laws are killed every month, and women suffer the physical and mental consequences of these dangerous drugs in addition to abuse and coercion.

“Failure to act on mail-order abortion drugs is a political mistake. Polling shows a strong majority of Americans–nearly 7 in 10–support getting these dangerous drugs out of the mail. It is also big priority for the base, with nearly a third of GOP voters saying they would be less enthusiastic to vote in the midterms if the GOP abandons pro-life policies.”

In their brief for expedited review, Louisiana makes the case that the Biden administration violated the Administrative Procedure Act (APA) when it put the mail-order abortion regime in place. Louisiana says Biden failed to consider adequate safety data and evaluate the harmful consequences of the policy, and instead acted for political reasons after the Dobbs decision according to HHS Secretary Kennedy’s own testimony to a Senate committee.

Previously the 5th Circuit Court of Appeals granted an immediate halt to the FDA’s policy allowing mail-order mifepristone. The Supreme Court then refused to stop the mail-order abortion drug regime during pending litigation.

Last Friday, a Louisiana man was charged with felony crimes for slipping an abortion drug do a woman without her knowledge. Local media reported the woman was hospitalized and had to undergo an emergency c-section. The baby, born at 23 weeks, was alive and remained hospitalized at the time of the report.

SBA Pro-Life America has documented several cases of abortion drug poisoning under the Joe Biden rule, including Jona Affholder’s story. Affholder was recently published by the Daily Wire detailing how her ex obtained abortion drugs online using his estranged wife’s information and she awoke to him force-feeding her the drugs. Affholder lost her child and ended up in the hospital.

New research from the Charlotte Lozier Institute shows 81% of online abortion businesses send mifepristone to kill unborn children far beyond the 10-week timeframe the FDA has established – putting women at increased risk for life-threatening complications. Other CLI research found three quarters of ER visits within 30 days after abortion drug use were coded as severe or critical. Two separate, independent studies also found more than 1 in 10 women experience at least one severe adverse event. Complications can include hemorrhaging, infection, sepsis, and even death.

SBA Pro-Life America and its affiliated entities plan to make a $160 million investment to elect pro-life leaders in the 2026 midterm and 2028 presidential election cycles.

Susan B. Anthony Pro-Life America is a network of more than one million pro-life Americans nationwide, dedicated to ending abortion by electing national leaders and advocating for laws that save lives, with a special calling to promote pro-life women leaders.
