Dannenfelser Calls on Attorney General to Settle in Abortion Drug Case Before Sept. 9

Washington, D.C. – With the release of a new Senate study on the dangerous practices of abortion drug manufacturers, Susan B. Anthony Pro-Life America is calling on the Department of Justice to end the mail-order of mifepristone by settling Louisiana v. FDA. U.S. Senate Health, Education, Labor and Pensions (HELP) Committee Chairman Bill Cassidy, joined by Sens. Steve Daines, Cindy Hyde-Smith, James Lankford, and the late Sen. Lindsey Graham launched an investigation into the three abortion drug manufacturers Danco Corporation, GenBioPro and Evita Solutions—a company that began selling abortion drugs last week after receiving approval from the FDA under then-Commissioner Marty Makary.

The report found that even the minimal remaining Risk Evaluation and Mitigation Strategies (REMS) are not being upheld by these manufacturers, especially in online situations. The three abortion drug manufacturers don’t meaningfully audit prescribers, only requiring a cursory form without follow up.

Louisiana is suing the FDA over the Joe Biden rule allowing abortion drugs to be sent through the mail without in-person doctor visits. The case is set to resume in the 5^th U.S. Circuit Court of Appeals on Sept. 9 with oral arguments. Prior to his confirmation, Attorney General Todd Blanche told the Senate Judiciary Committee, “We are not in any way defending what Biden and his administration did,” and a group of faith leaders he was working “so that the Dobbs decision becomes permanent in every single state” in relation to abortion drugs.

Cassidy’s research shows there is no way to address the harms of abortion drugs since Danco, GenBioPro, and Evita Solutions’ drugs are being shipped through the mail nationwide at all stages of pregnancy, including in the third trimester in North Carolina. Todd Blanche has the opportunity to protect women and save the lives of 15,000 babies every month by settling with the state of Louisiana before Sept. 9. He can end this fight with the red states, allow pro-life laws to finally take effect and stop the rise of criminals poisoning mothers with abortion drugs.”

The results of Sen. Cassidy’s investigation reinforce recent research from the Charlotte Lozier Institute showing 81% of online abortion businesses send mifepristone to kill unborn children far beyond the 10-week timeframe the FDA has established, putting women at increased risk for life-threatening complications.

Mail-order abortion drugs are enabling bad actors nationwide. A Texas man is facing criminal charges after authorities say he slipped abortion drugs to a pregnant woman—far past the FDA’s recommended timeframe—tragically killing her unborn daughter, Presley Mae, at approximately 14 weeks. Reportedly, the mother refused the man’s demands for her to abort her child, including his repeated offers to fund her out-of-state travel for an abortion. Last month in North Carolina, an 18-year-old ordered the drugs online and gave birth to a 31-week-old baby in a toilet. First responders performed CPR on the infant and revived its pulse before transporting the baby to the hospital.

This year, a nationwide survey conducted by Cygnal found that Republican primary voters overwhelmingly disapprove of allowing mail-order abortion drugs. Last fall, McLaughlin & Associates also found 7 in 10 likely voters—including 57% of liberal voters—approve of requiring a doctor visit to receive a prescription for abortion drugs.
