DOJ Doubles Down, Wants Abortion Drug Harm Lawsuit Dropped
Washington, D.C. – Late on Friday, the U.S. Department of Justice moved to dismiss Missouri v. FDA, doubling down on its claim that pro-life states and women harmed by abortion drugs lack standing and are not suffering ongoing harm from the U.S. Food and Drug Administration’s Covid-era policy of allowing deadly abortion drugs to be sent in the mail.
In the separate case of Louisiana v. FDA, the State of Louisiana, led by Attorney General Liz Murrill, and abortion drug coercion survivor Rosalie Markezich are suing the FDA based on the harms mifepristone has caused their residents and the fact that current FDA policy allowing mail-order abortion undermines dozens of state laws. In that case, the DOJ conceded that the Department of Health and Human Services can suspend approval for a drug that presents an “an imminent hazard to the public health.”
A nationwide survey conducted by Cygnal finds Republican primary voters overwhelmingly disapprove of allowing mail-order abortion drugs and back pro-life policies like the Hyde Amendment. One-third of those voters would be less enthusiastic about voting in November and less willing to volunteer if GOP leaders abandon pro-life policies.

“Once again, the Trump-Vance Justice Department is taking the side of abortion drug dealers and the radical Left against women and children, public health and safety, and the overwhelmingly pro-life GOP base. Burying this shameful move in a Friday evening news dump underscores how indefensible it is. On top of this, in a federal court hearing less than two weeks ago, the administration admitted it has NO details on the timeline for Commissioner Makary’s promised safety study of mifepristone – if indeed it has really begun.
“While Secretary Kennedy is focused on the scourge of Dunkin’ coffee and the DOJ has been busy litigating against concerned Republican leaders in ruby-red states, women and girls are under assault and babies are being killed. In the latest horrific case out of Texas, another woman was reportedly poisoned with mail-order abortion drugs and an already much-loved little girl named Presley Mae was stillborn. More Americans die from abortion drugs than fentanyl, cocaine and heroin combined. Haven’t we seen enough ‘American carnage’?
“The pro-life movement has very simple demands. There should be no place on the market for drugs meant to poison and kill innocent human beings – but at the very least, this administration can and should take them out of the mail. This is no more or less than the policy of the first Trump administration. With 8 in 10 of GOP base voters wanting to reinstate in-person doctor visits, and one third of the most engaged voters at risk of sitting out midterms, Trump-Vance world ignores this crisis at its own political peril.”
Sixty Republican U.S. senators and representatives and 21 Republican attorneys general filed amicus briefs supporting Louisiana in the case. Fifty-one senators and 175 representatives previously called on the FDA and HHS to reinstate commonsense safeguards on abortion drugs.
The U.S. Department of Justice has asked the court to deny relief for a year or potentially longer, pending a safety study of mifepristone promised by FDA Commissioner Marty Makary.
Peer-reviewed research found three quarters of ER visits within 30 days after abortion drug use were coded as severe or critical.
