On 4th Anniversary of Dobbs, Pro-Life Leader Rallies Movement to Protect Unborn Children Nationwide

Declaration of Independence for the Unborn Highlights Lives, Foundational Rights at Stake

Washington, D.C. – On the fourth anniversary of the Dobbs Supreme Court victory that reversed Roe v. Wade, SBA Pro-Life America President Marjorie Dannenfelser addressed the failure of a “states-only” approach to safeguarding the right to life after Dobbs and called on elected officials to pass ambitious protections for unborn children grounded in the 14th Amendment.

Ahead of America’s 250th birthday celebration, SBA Pro-Life America is encouraging pro-life citizens nationwide to sign the Declaration of Independence for the Unborn, which reads in part:

In 2022, the Supreme Court struck down Roe v. Wade and determined that the people’s representatives at all levels of government may now pass legislation to protect the unborn. This includes our national leaders. In the four years since that decision, half of the states have enacted pro-life laws—yet abortions have gone UP and not down in the United States. A “states-only” strategy on abortion doesn’t just fail, it is unjust. Where our people live does not determine whether or not they have the right to live.

The group has also updated its interactive maps at lifesavinglaws.com to reflect the status of pro-life laws, pro-life laws, “shield laws” that give immunity to mail-order abortion drug sellers, and more.

Recent data suggests abortions continued to rise in 2025, to well over 1.1 million annually, fueled primarily by the rise of abortion drugs that were first allowed by mail-order under the Biden administration.

On Tuesday, 83 pro-life leaders and groups led by SBA Pro-Life America sent a letter urging Acting Attorney General Todd Blanche to settle with the state of Louisiana and abortion drug coercion survivor Rosalie Markezich in their lawsuit against the U.S. Food and Drug Administration for allowing mail-order abortion drugs to harm women and children and undermine the laws of pro-life states.

In a new op-ed, Dannenfelser writes:

Some still mistakenly believe that the Constitution forbids the federal government from recognizing or protecting unborn children’s right to life in any way. Because of this, they view federal pro-life action with deep suspicion. States, they argue, are the only ones with the authority to protect the right to life — and should be free to choose whether to protect it or whether to attack and deny it without any limitation: even up until birth, or even across state lines.

This maximalist “states-only” position simply isn’t what the Constitution, or Dobbs, says. The Constitution allows states to protect life, but it doesn’t forbid the federal government from trying to do so, too. The 14th Amendment, in fact, explicitly charges Congress with the duty and authority to ensure the equal protection of the laws and to ensure that no state deprives anyone of life, liberty, or property without due process.

In a call Tuesday with Iowa pro-life leader Bob Vander Plaats, Dannenfelser highlighted the role early primary states Iowa and South Carolina—where the group’s canvassing team is already active on the ground—will play in determining the future of pro-life leadership in the Republican Party. Polling shows one third of GOP primary voters will be less enthusiastic to vote and volunteer in midterm elections if the party abandons pro-life policies.

SBA Pro-Life America and its affiliated entities plan to make a $160 million investment to elect pro-life leaders in the 2026 midterm and 2028 presidential election cycles.
