In New Letter, Women Harmed by Abortion Drugs Urge Blanche to Settle FDA Lawsuit Ahead of Confirmation Hearing

Washington, D.C. – In a new letter to Acting U.S. Attorney General Todd Blanche, women harmed by abortion drugs “respectfully but urgently” ask the Department of Justice to “side with Rosalie Markezich and settle her legal case immediately so abortion drugs are no longer sent through the mail in ways that put women at risk.”

Markezich, a survivor of abortion drug coercion, is suing the U.S. Food and Drug Administration for removing in-person guardrails on dangerous abortion drugs (Louisiana v. FDA). Over the DOJ’s opposition, the 5th U.S. Circuit Court of Appeals granted an expedited hearing that will take place in September.

The letter continues in part:

We grieve with Rosalie because many of us recognize parts of our own stories in hers: the pressure, the confusion, the fear, the absence of real medical care, and the feeling that the system was designed to move drugs faster than it was designed to protect women. No woman should be forced, pressured, deceived, or abandoned into taking drugs that end her child’s life and place her own health at risk.

The FDA’s illegal abortion drug policy is responsible for this danger, and it is the same policy the Department is defending in court. This is not abstract. Rosalie herself says, “If mail-order abortion wasn’t a thing, I’m 100% sure I would have my child…. I do not believe a doctor would have prescribed me the drugs if I told her I did not want them.”

Last month a coalition of 83 state and national pro-life groups, led by SBA Pro-life America, urged Blanche and the DOJ to resolve the lawsuit by agreeing to a court-ordered consent decree that would get abortion drugs out of the mail immediately while the FDA completes a prompt, rigorous safety review.

Blanche is scheduled to appear for a confirmation hearing in the Senate Judiciary Committee on July 15 for consideration of his nomination by President Trump to serve as attorney general. U.S. Senator Josh Hawley (R-MO), a member of the committee, has also called on Blanche to settle the case.

“The crisis of mail-order abortion drugs is not an accident or coincidence but a direct result of Biden federal policy. The harm they inflict on women and children is growing daily and can’t be ignored. SBA Pro-Life America has documented numerous cases of abortion drug coercion and violence across the nation, including a U.S. Army captain recently sentenced to 12 years in prison for poisoning a junior soldier with mifepristone and killing their unborn child. These are inherently dangerous drugs that do not belong where they can easily get into the hands of abusers. The courage of these women, increasingly coming forward to share their very personal suffering and advocate to spare others the same terrible trauma, cannot be understated. Common sense tells us they should not have to wait months or more for justice and change from this administration. Again we implore Acting AG Blanche as the Senate weighs his nomination: please, listen to the survivors and settle the case without further delay.”
