Court Recognizes Iowans’ Right to Enact Life-Saving Laws; Millions More Lives at Stake in Dobbs Case
Washington, D.C. – Susan B. Anthony Pro-Life America celebrated today as the Iowa Supreme Court reversed a 2018 decision imposing a “right” to abortion in the state constitution that would have prevented Iowans from enacting strong pro-life protections once Roe is overturned. The Court also paved the way toward ensuring a 24-hour reflection period before an abortion can be performed.
The Iowa Supreme Court ruled there is NO right to abortion in the Iowa constitution stating:
“Hence, all we hold today is that the Iowa Constitution is not the source of a fundamental right to an abortion necessitating a strict scrutiny standard of review for regulations affecting that right. For now, this means that the Casey undue burden test we applied in PPH I remains the governing standard. On remand, the parties should marshal and present evidence under that test, although the legal standard may also be litigated further.”
The national pro-life group Susan B. Anthony Pro-Life America celebrated the decision saying:
“Today’s decision from the Iowa Supreme Court is a landmark win for unborn children and their mothers and the people of this deeply pro-life state. The Court has finally recognized the right of Iowans to speak through their elected representatives on this pivotal human rights issue,” said SBA Pro-Life America President Marjorie Dannenfelser. “We thank all our local allies, especially courageous Governor Kim Reynolds, for their persistence and we hope this foreshadows greater victories to come. If the draft opinion in the Dobbs case holds, all Americans will be free to protect children in the womb and truly empower women, through every state legislature and Congress, absent activist state courts. Life is winning in America and now is the time for pro-life leaders in every corner of our nation to be bold in advocating policies that save lives.”
In Dobbs v. Jackson Women’s Health Organization, the U.S. Supreme Court will address whether pre-viability limits on abortion are constitutional.
